VIXY B.V. (“VIXY”, “we”), located at Naarderweg 16, 1217 GL Hilversum, the Netherlands, is responsible for the processing of personal data as described in this privacy policy. This privacy policy applies to our website (vixyvideo.com), our marketing and sales activities, and our own business operations.

Two roles: when this policy applies

VIXY processes personal data in two distinct roles.

VIXY as controller. For our own website, marketing, sales, trial accounts, customer administration, support and recruitment, VIXY determines how and why personal data is processed. This privacy policy covers that processing.

VIXY as processor. Organizations use the VIXY platform to host, manage and deliver video. Any personal data processed through the platform on their behalf, such as technical identifiers (user IDs and IP addresses), names and email addresses of platform users and viewers where the organization’s configuration requires this, and personal data contained in video content and metadata, is processed by VIXY as processor, under the instructions of that organization as controller. This processing is governed by our data processing agreement, which together with Chapter 4 of the NLdigital Voorwaarden 2025 forms the processor agreement within the meaning of article 28(3) GDPR. If you have watched a video hosted by VIXY on another organization’s website or platform, that organization is the controller of your personal data, please direct privacy questions and requests to them; we will assist them in responding where required.

The analytics and marketing tools described in this privacy policy and in our cookie policy are used on our website only: the VIXY video platform and video player do not contain advertising or marketing trackers. Any cookies or similar techniques used by the platform or player are functional, and their use is covered by the data processing agreement with the client organization.

Personal data we process as controller

VIXY processes personal data because you use our services or because you provide it to us yourself. Depending on your relationship with us, this may include:

  • Contact and lead data: first and last name, email address, phone number, company name and job title, for example when you fill in a contact form, request a demo or download content.
  • Account and trial data: the details you provide when starting or continuing a VIXY account, including company and payment details.
  • Billing and administration data: invoice details, VAT number, payment records.
  • Support communications: the content of your messages to our support team and the associated contact details.
  • Website usage data: IP address (anonymized for analytics), browser and device characteristics, and pages visited.
  • Application data: if you apply for a position at VIXY, the information in your application, such as your CV and motivation.

Special and/or sensitive personal data

Our website and services are not intended to collect data about visitors younger than 16 without parental or guardian consent. We cannot verify a visitor’s age, so we encourage parents to be involved in their children’s online activities. If you believe we have collected personal data about a minor without such consent, contact us via info@vixyvideo.com and we will delete the information.

Purposes and legal bases

We process personal data for the following purposes:

  • Performing our agreement with you (or taking steps before entering into one): setting up and running trial accounts, delivering and supporting our services, and customer administration.
  • Legitimate interest: contacting you by phone or email where needed for our services, business-to-business marketing and relationship management, improving our website and services through (anonymized) analytics, and securing our systems and preventing misuse.
  • Consent: sending our newsletter and placing non-essential cookies. You can withdraw your consent at any time, every newsletter contains an unsubscribe link.
  • Legal obligation: processing we are legally required to carry out, such as retaining records for our tax administration.

Automated decision-making

VIXY does not make decisions based solely on automated processing that could have (significant) consequences for individuals.

How long we retain personal data

VIXY does not retain your personal data longer than strictly necessary for the purposes for which it was collected. In particular: financial and administrative records are kept for 7 years (statutory fiscal retention); newsletter data until you unsubscribe; lead and contact data no longer than three years after the last contact; application data is deleted no later than 12 weeks after the end of the application procedure, or retained up to one year with your consent.

Sharing personal data with third parties

VIXY shares personal data with third parties only where necessary to perform our agreement with you or to comply with a legal obligation. With companies that process your data on our behalf, such as hosting, CRM, email, support and accounting providers – we conclude data processing agreements to ensure the same level of security and confidentiality. VIXY remains responsible for these processing operations. We do not sell personal data.

Where your data is processed

Video content and associated personal data on the VIXY platform are stored and managed within the European Union, by default in the Netherlands, and VIXY B.V. is ISO 27001 certified. To deliver video quickly and reliably to viewers around the world, we use content delivery network (CDN) partners: when a video is watched from outside the European Union, content may be temporarily cached on CDN servers close to the viewer, including outside the European Economic Area. Where personal data is transferred outside the EEA, for example in the context of such delivery, this only takes place under an adequacy decision of the European Commission or appropriate safeguards such as the EU Standard Contractual Clauses (Commission Implementing Decision 2021/914/EU).

Cookies

VIXY uses cookies and similar techniques on this website. Functional cookies are necessary for the website to work; analytical and marketing cookies, such as those of Hotjar, Leadfeeder and LinkedIn, are placed on this website only, and only in accordance with your preferences. These techniques are not used in the VIXY video platform or video player.

Your rights: access, rectification, erasure and more

You have the right to access, rectify or erase your personal data, the right to restrict processing, the right to object to processing, the right to data portability, and the right to withdraw any consent you have given. You can send your request to info@vixyvideo.com. To protect your privacy, we may ask you for additional information to verify your identity before handling the request. We respond as quickly as possible, and in any case within one month.

You also have the right to lodge a complaint with the Dutch supervisory authority, the Autoriteit Persoonsgegevens, via autoriteitpersoonsgegevens.nl.

How we protect personal data

VIXY takes the protection of your data seriously and takes appropriate technical and organizational measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized alteration. Our information security management system is ISO 27001 certified. If you believe your data is not properly protected or you see indications of misuse, contact us via info@vixyvideo.com.

Changes to this Privacy Policy

VIXY may update this privacy policy from time to time, for example when our services or legislation change. The most recent version is always available on this page; the date of the last update is shown at the top.
